Terms of service

The most important parts have been highlighted in bold, however, please read through the entire T.O.S before commissioning me.

Commission Terms:

- By agreeing to these Terms of Service, you confirm that you are 18 years of age or older.- I reserve the right to refuse / cancel my services to anyone for any reason at any time and do not have to provide a reason for the case of refusal / cancellation.- I outright refuse to work with the listed models below;
* Rexouium models regardless of modifications done to the model. Meaning by extension any models created by Rezillo Ryker.
* Nanachi / zoichi bases.
* Any "Thine" models.
* Deira bases unless heavily modified.- The artist retains the copyright to the work done; even if the client owns the characters in the work.- Have all the information ready from the very beginning. Stick to clear details, in bullet form, with clear reference/pictures. I will not work off character descriptions or traditionally drawn references unless very clear pictures and provided hex colors. Where this becomes inapplicable is during projects where development is at the focal point.- I am not to be liable or responsible for the client's inexperience with the software and or experience that is required to use my work.- The client must provide proof of purchase of the base model / parts that they want modified / retextured. Unique key / screenshot of purchase through Gumroad must be provided. If you are found to be using ripped, or otherwise acquired assets without proof of purchase, you will be blacklisted from commissioning me.- The files provided at the end of completion will only contain Meshes and textures. No Substance files, no Paid Shaders, etc. Unless a unity scene is requested for setup, then a scene with meshes, textures and model will be provided.- All prices are subject to change depending on complexity of characters / commission idea unless a flat price is stated.- You agree that your comments will not violate any right of including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material. If you have a problem, take it up with me personally.- You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the work, use of the Service without written permission by me.-The client has permission to post art / use the assets freely within any personal projects, but is not to be published publicly for others to use. If you are commissioning for someone else, contact me through Discord.- Always credit the artist, even in derivative work, for the original work.- The client cannot remove my information off any piece for any reason, i.e. erasing my signature, removing my information, removal of logo etc.- Clients will be provided with WIPs before initial setup in unity. Up to 2 changes will be permitted at the modelling phase, 2 additional changes for the texturing phase. After this an additional charge will be added for every change.- Once the completed work file has been sent, no further additions or edits will be made.- If the client fails to pay the remaining amount / full amount once the commission is complete, unless a payment plan has been agreed upon, the ownership of meshes, textures and all work that has been done will be forfeited from the client, and will remain in the creators ownership as their property to do as they wish with.Payment- All payments will be done through PayPal.- Payment will be handled in the form of an invoice.- Depending on the commission, I will require 25% payment upfront before work is started.- No work will be started until payment is received if 25% of the commission is applicable up front.- I shall not be liable to you for any modification, price change, suspension or discontinuance of the Service i.e. Exchange rates, transaction fees etc.- If prices were to change during an already active commission, the prices of started commissions will not be subject change.- If payment is not received within 48 hours, (If applicable), the slot will be given to the next customer in the queue for when it is applicable.- Payments plans are possible for Service that has a value greater than $200.00 USD.- There will be no refunds due to the products provided being digital.Deadlines- The standard deadline for a commission is a month from the start date of the commission, (28 work days, Monday to Friday), or a rush fee will apply. ($50.00 USD)- If the client's wait time exceeds 3 months after the initial payment, and/or start of commission the artist will automatically refund unless discussed otherwise. This is to ensure an up-to-date queue.- For projects; projects being commissions that require an extensive amount of work, the wait time is not applicable, and the client acknowledges that it can take up to 6 months to a year for the project to reach completion.- I do not guarantee, represent or warrant that your use of my service will be uninterrupted, timely, secure or error-free.Commercial UseThe following constitutes the summary for my basic license agreement for commercial use. By engaging in the commercial use of my original creative works you agree to adhere to the following rules. For a complete license agreement including additional terms for royalty or other compensation for use of my intellectual property in commercial use, please contact me directly.- If the client is to use the commissioned creation in any commercial capacity, credit to the artist needs to be clearly visible, readable and easy to find.- For VRChat specifically, the use of any of my creations are to be credited in the sales page under a credit section, and in the menu of the avatar in question.- You are only allowed re-distribute the creation on a complete model that is paid to use. - You are not allowed to re-distribute my assets or any of my creations on a free model or by itself unless you have written permission by me.- Failure to uphold these rules will lead to a permanent ban from my services. All of the commercial licensing will be revoked and followed with legal actions.I hold the right to change, modify and edit my Terms of Services, and price at any given time, Changes will be notified 2 weeks in advance.
